Dinesh D’Souza Unveils Bold Plan to End Birthright Citizenship Loopholes

The Supreme Court’s recent birthright citizenship decision has sparked fierce debate across the nation, but author and commentator Dinesh D’Souza believes many conservatives are focusing on the wrong issue.

In a recent episode of his podcast, D’Souza argued that the real crisis is not simply the Court’s interpretation of the Constitution but what he views as a deeper flaw in modern conservative legal philosophy.

“The Supreme Court decision on birthright citizenship has produced a national crisis, but not for the reason that most people think,” D’Souza said.

According to D’Souza, the greatest concern surrounding birthright citizenship involves what he calls “birth tourism,” in which foreign nationals travel to the United States specifically to give birth so their children automatically receive American citizenship.

“We’re talking about birth tourism,” D’Souza said. “That’s the core issue.”

While acknowledging that constitutional arguments exist on both sides of the debate, he argued that today’s circumstances differ dramatically from those present when the 14th Amendment was adopted following the Civil War.

“Our opposition derives entirely from the consequences of birthright citizenship and birth tourism,” he said. “The circumstances have changed.”

D’Souza believes conservative jurisprudence has boxed itself into a framework that largely excludes consideration of real-world outcomes.

“I’m saying it’s time to put 30 years of conservative jurisprudence on trial,” he said. “We have talked our way into a box.”

Instead, he proposed what he described as a “MAGA jurisprudence” that would preserve constitutional principles while allowing courts to consider the practical effects of their rulings.

“We have to reintroduce consequential reasoning into our constitutional jurisprudence,” D’Souza said. “Principles must give way to reasonable exceptions. When the consequences are bad, stop applying the principle.”

As an example, he pointed to First Amendment jurisprudence, arguing that although free speech is constitutionally protected, courts have long recognized exceptions involving threats, criminal conspiracies and other narrowly defined circumstances.

D’Souza suggested a similar framework could distinguish between children born to long-term U.S. residents and those born to individuals who entered the country solely for the purpose of obtaining citizenship for their children.

Later in the program, D’Souza interviewed Texas Attorney General and U.S. Senate candidate Ken Paxton, who discussed religious liberty, Sharia law, immigration and election integrity.

“I believe what the founders put in place in the First Amendment… has been fundamental to our country,” Paxton said. “But when we look at what’s going on in Europe and allowing Sharia law… to take over the legal system, that’s where I start having difficulties because those laws are in conflict with our Constitution.”

These debates also serve as a reminder that while governments wrestle with justice and law, the ultimate wisdom comes from the Lord. Scripture reminds us that “righteousness exalts a nation” (Prov. 14:34), making discernment, prayer and biblical conviction essential as America continues navigating some of its most consequential legal and cultural battles.
